Deputy Vladimir Bidyovka comments on number of basic laws signed by Acting DPR Head
On September 10, six laws were published on the official website of the DPR People’s Council: “On the Ministry of State Security,” “On the Investigative Activities,” “On the Judicial System of the Donetsk People’s Republic,” “On the Status of Judges,” “On the Prosecutor’s Office,” as well as the Criminal Procedure Code of the Donetsk People’s Republic.
It is worth noting that some of them contain suspensive norms. The Law “On the Ministry of State Security” comes into force in 10 days, as well as the Criminal Procedure Code is put into effect also after 10 days.
The law “On the Judicial System of the Donetsk People’s Republic” comes into force on January 1, 2019. The most significant for the legislation of the Republic with the adoption of this law is that Article 20 defines provisions relating to the appeals court. Also, the law provides for three months from the date of its entry into force the formation of the Appeals Chamber of the DPR Supreme Court as the Court’s Chamber of the Court.
The key points that should be addressed in the Law “On the Status of Judges” are that judges of the Supreme Court of the Donetsk People’s Republic, including the chairman and their deputies, are appointed by the People’s Council on the recommendation of the DPR Head for a period of six years. In addition, the DPR Head has the authority to appoint judges of courts of general jurisdiction.
The Law “On the Ministry of State Security” defines in more detail the procedure for carrying out operational actions, and the Law “On the Prosecutor’s Office” defines the full scope of the powers of the Prosecutor’s Office for carrying out the tasks assigned to it.
Undoubtedly, we will face certain divisive issues that can be identified only in the course of law enforcement practice. Given our reality, as well as the fact that we have already encountered similar difficulties, no serious problems should be expected regarding this. The People’s Council is quite agile in such situations and, following the results of their analysis, initiates the introduction of changes to the current legislation.
