The benefit applies only to one apartment or house, regardless of the number of family members living together with the person, who receives the benefit, and the benefit covers the entire amount of a housing and communal services fee accrued to the said house or apartment. ʺThe law provides a benefit to pay housing and communal services of the entire house or apartment. It covers the entire amount of a housing and communal services fee accrued to the said house or apartment.
In connection with the adoption of the law “On social protection of family members of those people, who fell defending the Donetsk People’s Republic”, the procedure of granting the benefit to these people will be developed and approved by the Council of Ministers of the Donetsk People’s Republic. According to the law “On normative legal acts”, executive authorities have three months to develop this procedure,ʺ Marina Zheynova said.
She added that the benefit that frees from paying housing and utilities services applies to one apartment or house, in which the person, who is granted this benefit, and family members live.
ʺAccording to the law, the family members of a deceased include a widow (widower), parents, children, as well as people, which were dependent on the deceased person. Or if there were no such residents at the time of death, in accordance with the Civil Code, in terms of the order of succession, this benefit is granted to, first of all, a widow or widower,ʺ Marina Zheynova said.
Also she underlined that in case of discrepancy of the norms of the new law with the current legislation with regard to the regulation of this relations, the law “On social protection of family members of those people, who fell defending the Donetsk People’s Republic” would be applied.
ʺSince this document is a more recent normative legal act and it is a special one in this area,ʺ Marina Zheynova summed up.
