People’s Council provides explanations on right to receive benefits in form of exemption from payment of communal housing fees

The DPR People’s Council deputy, Secretary of the Committee on Social and Housing Policy Ekaterina Pavlenko clarified the provisions of the Donetsk People’s Republic’s law “On social protection of family members of those people, who fell defending the Donetsk People’s Republic”, which came into force on October 6.

According to the parliamentarian, the Committee made an official explanation, the content of which was described to the press service of the People’s Council.by her.

ʺThe law applies to families of those people, who did not have the status of military personnel and fell repulsing the Ukraine’s act of aggression against the Donetsk People’s Republic. In accordance with this normative legal act, a certain category of citizens will become eligible to receive benefits in the form of exemption from payment of communal housing fees.

Obtaining the status of a family member, who died while defending the Donetsk People’s Republic, will be implemented through information provided by the authorized Republican executive authorities, in accordance with the Article 4, Part 51 of the DPR’s law “On social protection of war veterans”.

In addition, the procedure for granting the benefit stipulated by Article 3 of the law “On social protection of family members of those people, who fell defending the Donetsk People’s Republic”, is subject to approval the Council of Ministers within a period of three months from the date of entry of the law into force. The benefit in the form of exemption from payment for housing and communal services will be given to the family members (family) of a deceased, who were cohabiting with the one at the time of his death. In their absence, the benefit may be granted to another family member referred in Article 2, who were cohabiting separately.

The benefit applies only to one apartment or house, regardless of the number of family members living together with the person, who receives the benefit, and the benefit covers the entire amount of a housing and communal services fee accrued to the said house or apartment. At the same time, a widow or a widower loses the right to a privilege at re-marriage,ʺ the deputy said.

In conclusion, Ekaterina Pavlenko added that, in case of discrepancy of the law “On social protection of family members of those people, who fell defending the Donetsk People’s Republic” with other normative legal acts that regulate similar public relations, the law “On social protection of family members of those people, who fell defending the Donetsk People’s Republic” is to be applied as special and more recent normative legal act.
