Vladimir Bidyovka’s statement on position of DPR’s Ministry of Education and Science concerning legitimacy of People’s Council’s Provisional Commission

In a conversation with the press, the Chairman of the DRP’s People’s Council clarified a situation concerning the legitimacy of the Provisional Commission of the DPR’s People’s Council regarding the verification of the legitimacy of refusal to give state accreditation to a state educational institution of higher vocational education “Donbass Law Academy”, in which representatives of the Ministry of Education and Science had previously doubted.

Also, the parliamentary speaker mentioned facts, which were obtained during the Commission’s work and testified to the incorrectness of a procedure implemented by the accreditation board, which had made a decision not to issue a license to the educational institution.

ʺThe Ministry of Education and Science questioned the legitimacy of the Provisional Commission of the People’s Council of the Donetsk People’s Republic concerning the verification of the legitimacy of refusal to give state accreditation to a state educational institution of higher vocational education “Donbass Law Academy”

I would like to draw attention, first of all, to the fact that the Provisional Commission was established in accordance with the Regulations of the DPR’s People’s Council and Article 69 of the Constitution of the Donetsk People’s Republic, which provides the People’s Council with a right to monitor the implementation and enforcement of laws. There are no reasons to call the Commission illegitimate. Moreover, instead of the assessment by the Ministry of Education and Science of People’s Council’s activity, I would like to call the management to develop necessary regulatory legal acts of the Republic, because bodies of the Ministry used an Order of the Ministry of Education and Science, Youth and Sports of Ukraine No. 665 dated 01.06.2013 ʺOn approval of qualification characteristics of professions (positions) of teachers and scientific-pedagogical workers of educational institutionsʺ when making decisions on a state educational institution of higher vocational education “Donbass Law Academy”.

I understand that we do not yet have the entire legal framework, but I consider it unacceptable to use the legal acts of Ukraine in such important matters in the sixth year of the Republic’s life.

According to the available information, I would like to note that the Ministry of Education and Science, for some reason, is concealing the fact that the people who carried out the accreditation expertise of the Donbass Law Academy – merited scientists – gave a positive assessment and decided to give a positive opinion on granting accreditation to the Academy. At the same time, during the work of our Commission, according to these people, we learned that after a positive decision on granting accreditation, they were deprived of the status of experts for the implementation of this procedure. We believe that it is unacceptable to exert such pressure in our legal state.

Also, the Ministry of Education and Science did not take into account the fact that the Donetsk People’s Republic lacks the Dissertation Council to defend theses for the degree of a Candidate of Sciences and Doctor of Sciences in the direction of “Jurisprudence”. Today, there are only two doctors of law in Donetsk People’s Republic, and when the Ministry of Education and Science sets requirements to the educational institution on personnel issues, then it is the work of the Ministry to create all conditions for defending theses.
